Bonne nouvelle pour la communauté Ejama-Ebubu Nigériane. En effet, la branche nigériane de Shell a accepté, mercredi 11 août 2021, d’indemniser la communauté Ejama-Ebubu du Delta du Niger, au Nigéria à hauteur de 110 millions de dollars, pour une affaire de pollution survenue en 1970. Cela équivaut à 45,7 milliards de nairas.
Ce règlement devrait mettre fin à une procédure judiciaire déclenchée en 1991. Rappelons que, depuis plusieurs décennies, Shell fait face à de nombreuses accusations de déversements de pétrole dans la région productrice du Delta du Niger. Les communautés affectées par ces déversements poursuivent actuellement la société devant des tribunaux locaux et étrangers.
La justice nigériane avait confirmé, en novembre 2020, la sentence initialement prononcée dix ans plus tôt pour un montant de 467 millions de dollars. Shell, qui se défend toujours de ne pas être responsable de la marée noire, a estimé que ce montant était trop élevé et a même recouru à un tribunal arbitral.
Selon un courriel du porte-parole de la filiale nigériane de Shell, « le paiement est destiné à satisfaire pleinement et définitivement une décision de justice rendue contre la société il y a 11 ans ».
Pour rappel, l’origine du grief de cette communauté Ejama-Ebubu contre Shell remonte à la rupture de l’un des plus gros pipelines de la société en 1970 dans l’Etat producteur de Rivers. Pour Shell, la rupture a été entraînée par les personnes impliquées dans le vandalisme des oléoducs pendant la guerre civile. La société affirme qu’ils sont responsables des dommages environnementaux liés à la situation et qu’elle a nettoyé les sites pollués, ce à quoi plusieurs ONG de protection de l’environnement s’opposent. D’après elles, de nombreux sites, cours d’eau notamment, demeurent pollués.
