En France, ce mercredi 15 décembre, magistrats, greffiers et avocats se mobilisent. Des rassemblements sont prévus devant les tribunaux pour réclamer des moyens dignes pour la justice. Une justice qui se porte mal selon les organisateurs de cette journée.
Dix sept organisations professionnelles et syndicales de la justice appellent à la mobilisation pour mettre sur la place publique le raz le-bol-général de tous les acteurs de la justice en France. Tous réclament plus de moyens humains mais aussi matériels.
Les deux principaux syndicats de magistrats ont déposé des préavis de grève, une « première » pour l’USM, majoritaire – et appellent avec les représentants des greffiers et des avocats à des « renvois massifs » des audiences pour montrer la détermination de l’ensemble de la profession. Des rassemblements sont prévus à la mi-journée devant la plupart des cours d’appel et devant certains tribunaux.
Des tribunaux surchargés
« L’appel à la mobilisation comprend à la fois un appel à la grève, donc effectivement un arrêt temporaire du fonctionnement des juridictions avec un renvoi surtout de toutes les audiences… c’est un mouvement dans la durée, nous explique Céline Parisot, présidente de l’ Union syndicale des magistrats, au micro d’Olivier Chermann du service France. C’est-à-dire (qu’) on ne peut plus travailler, aujourd’hui, comme on le fait, on doit dire stop. Et il y a des outils pour cela, qui sont notamment le renvoi des dossiers, lorsque les audiences sont surchargées, le renvoi des dossiers à plus tard. Effectivement, les délais sont déjà longs et vont peut-être l’être encore plus. Mais préfère-t-on être jugé tout de suite par des juges épuisés que dans trois mois ou dans six mois dans de meilleures conditions et avoir le temps d’être écouté. Je pense que si l’on pose la question aux citoyens, la réponse sera assez évidente. »
On demande plus de moyens c’est à dire « d’avoir le temps d’écouter les personnes qui saisissent la justice, poursuit Céline Parisot, d‘avoir le temps de rendre des décisions de qualité, et non pas fonctionner en mode dégradé comme on le fait aujourd’hui. On va trop vite, l’oeil sur le compteur pour essayer d’abattre les piles de dossiers qui s’accumulent sur nos bureaux. »
Mobilisation sans précédent
Une mobilisation sans précédent qui intervient trois semaines après la publication d’une tribune intitulée « Nous ne voulons plus d’une justice qui n’écoute pas, qui raisonne uniquement en chiffres, qui chronomètre et comptabilise tout » publiée par le quotidien Le Monde. Elle avait été écrite par neuf jeunes magistrats après le suicide fin août d’une de leurs collègues, Charlotte. Une colère partagée par l’ensemble de la profession puisque la contestation a même gagné la Cour de cassation, note l’Agence France presse : les magistrats de la plus haute juridiction de l’ordre judiciaire ont, dans une rare prise de position, dénoncé ce lundi « une justice exsangue, qui n’est plus en mesure d’exercer pleinement sa mission dans l’intérêt des justiciables ».
Les organisateurs de cette journée soulignent que la problématique des moyens est totalement évacuée des états généraux de la justice et du discours ministériel. Faux répond le Garde des sceaux : Eric Dupond-Moretti a défendu son bilan en rappelant de nouveau le budget « historique » pour la justice qui a connu deux hausses successives de 8% ces deux dernières années.
