La Commission vérité et réconciliation ayant enquêté en Gambie sur les crimes commis durant les vingt-deux ans de pouvoir du dictateur Yahya Jammeh a recommandé, vendredi 24 décembre, dans un rapport, des poursuites judiciaires devant un tribunal international contre le dirigeant et plusieurs éventuels complices. La Commission souhaite un procès « dans un pays d’Afrique de l’Ouest autre que la Gambie, sous l’égide de la Communauté économique des Etats ouest-africains (Cédéao) et/ou de l’Union africaine », pour notamment « meurtres, détentions arbitraires, disparitions ».
Ce tribunal pourrait être similaire à celui qui a jugé au Sénégal l’ancien chef d’Etat Hissène Habré, qui a dirigé le Tchad de 1982 à 1990. M. Habré, décédé en août du Covid-19, avait été condamné à la prison à vie en 2016 par une juridiction africaine pour crimes contre l’humanité, viols, exécutions, esclavage et enlèvement.
« Le Sénégal a [toujours] en place l’infrastructure nécessaire qui avait jugé Hissène Habré. Le Ghana est une autre option », de même que la Sierra Leone, dit le rapport de la Commission vérité, réconciliation et réparations (TRCC), présenté vendredi à Banjul par le ministre de la justice Dawdu Jallow. « Durant une période de vingt-deux ans, à partir du 22 juillet 1994, Yahya Jammeh et ses collègues [membres de l’APRC, le parti présidentiel] et d’autres coauteurs ont perpétré de graves crimes en Gambie », dit le rapport.

Le document en dix-sept volumes avait été remis le 25 novembre au président Adama Barrow par la Commission qui n’avait pas publié son contenu. La TRCC a rendu compte de l’étendue des crimes perpétrés sous Yahya Jammeh dans ce petit pays pauvre et enclavé d’Afrique de l’Ouest : assassinats, actes de tortures, disparitions forcées, viols et castrations, arrestations arbitraires, chasses aux sorcières, jusqu’à l’administration contrainte d’un faux traitement contre le sida. Entre 240 et 250 personnes sont mortes entre les mains de l’Etat et de ses agents, selon elle.

La Commission, créée en 2017, a entendu de janvier 2019 à mai 2021 393 témoins, victimes et anciens « junglers » (« broussards »), les membres des escadrons de la mort du régime, venus raconter au cours d’auditions publiques parfois bouleversantes les atrocités du régime. De nombreuses dépositions ont directement mis en cause M. Jammeh.
Le ministre de la justice Jallow a affirmé que le gouvernement gambien était « engagé à appliquer les recommandations du rapport ». Il a réaffirmé l’annonce déjà faite par le gouvernement de publier « un livre blanc » sur ces recommandations au plus tard le 25 mai 2022.
« Beaucoup de pressions en Gambie et à l’étranger »

Le rapport de la TRRC est publié deux semaines après la réélection du président Adama Barrow dont l’élection en 2016 a mis fin à plus de vingt ans de dictature. S’exprimant sur des poursuites contre les auteurs de crimes dans les années Jammeh, M. Barrow avait le 7 décembre, à l’annonce de sa réélection, déclaré : « Je prends part à la décision, mais ce n’est pas entièrement ma décision. » La décision sera prise en concertation avec son gouvernement et après consultation d’experts, avait-il déclaré. M. Barrow a six mois pour se prononcer.
La TRRC avait qualifié dans un rapport d’étape publié en avril 2020 les violations des droits humains sous Yahya Jammeh de « massives, effroyables et diverses ». Après la présidentielle de fin 2016 remportée par M. Barrow et six semaines d’une crise à rebondissements provoquée par le refus de M. Jammeh de céder le pouvoir, ce dernier avait finalement dû quitter le pays pour la Guinée équatoriale, sous la pression d’une intervention militaire ouest-africaine et à la suite d’une ultime médiation guinéo-mauritanienne.
