ARTICLE 19 appelle l’Union Africaine et la Communauté économique des Etats d’Afrique de l’Ouest (CEDEAO) à s’assurer que la protection des droits humains soit au centre des discussions avec le gouvernement de transition du Burkina Faso. En effet, la prise du pouvoir constitue un nouveau « recul de la démocratie » en Afrique de l’Ouest, après les coups d’État en Guinée Conakry et au Mali.
« Le gouvernement militaire actuellement au pouvoir au Burkina Faso a récemment annoncé qu’il rétablissait la Constitution qui avait été suspendue après le renversement du président Kabore. La Constitution fournit des garanties importantes pour la protection des droits de l’homme, notamment les droits de manifester, d’accès à l’information et de s’exprimer librement. Ces droits doivent être rétablis dans le pays et être considérés comme prioritaires par l’UA et la CEDEAO dans leurs discussions avec le gouvernement de transition. De son côté, le gouvernement de transition, s’il s’engage à restaurer la Constitution, doit respecter ces droits et tous les autres droits humains », a déclaré Fatou Jagne Senghore, directrice régionale d’ARTICLE 19 pour l’Afrique de l’Ouest.
ARTICLE 19 réitère que le fait de ne pas autoriser une manifestation ne la rend pas en soi illégale. En fait, la résolution adoptée par le Conseil des droits de l’homme reconnaît que « des manifestations pacifiques peuvent avoir lieu dans toutes les sociétés, y compris des manifestations spontanées, simultanées, non autorisées ou restreintes ».
Par ailleurs, ARTICLE 19 rappelle aux autorités l’appel lancé par le Secrétaire Général de l’ONU aux États pour qu’ils « veillent à ce que les mesures antiterroristes ne portent pas atteinte à l’espace démocratique et civique, à ce que les acteurs de la société civile puissent agir efficacement sans crainte de représailles, et à ce que l’action antiterroriste ne serve pas de prétexte pour faire taire la dissidence ou l’opposition.
Il a également appelé à la protection de la liberté d’expression. Il a en outre appelé à « la promotion, la protection et la jouissance des droits de l’homme sur Internet », affirmant que : les mêmes droits que ceux dont jouissent les personnes hors ligne doivent également être protégés en ligne.
ARTICLE 19 demande aux autorités du Burkina Faso de soutenir les politiques qui maintiennent l’accès à l’Internet pour tous, conformément à leurs obligations internationales, et s’abstenir de restreindre l’accès à l’Internet à l’avenir.
