Une décision sans précédent et une avancée pour les Colombiennes. La Cour constitutionnelle de Colombie a dépénalisé, lundi 21 février, l’avortement jusqu’à 24 semaines de grossesse. Cette mesure intervient dans un contexte de libéralisation de l’interruption de grossesse en Amérique latine.
Dans son arrêt, la Cour constitutionnelle autorise les femmes à avoir recours à l’avortement pour n’importe quel motif jusqu’au sixième mois de gestation. À titre de comparaison, en France, l’IVG peut être pratiquée jusqu’à la fin de la douzième semaine de grossesse.
Jusqu’à présent, ce n’était autorisé qu’en cas de viol, si la santé de la mère était en danger ou lorsque le fœtus présentait une malformation compromettant sa survie, selon un arrêt de 2006 de la Cour, qui prévoyait l’objection de conscience pour les médecins qui ne voulaient pas procéder à une interruption de grossesse.
En dehors de ces exceptions, les femmes qui avaient recours à l’avortement étaient passibles d’une peine de 16 à 54 mois d’emprisonnement.
Toujours passible de prison après 6 mois de grossesse
Désormais, « l’acte d’avortement ne sera punissable que s’il est pratiqué après la vingt-quatrième semaine de gestation », a déclaré la Cour constitutionnelle dans un communiqué. Après six mois de grossesse, les conditions déjà fixées par le tribunal resteront en place, ont précisé les magistrats.
Des centaines de manifestants pro et anti-avortement se sont rassemblés devant la Cour constitutionnelle. Les militantes pro-avortement, qui arboraient une écharpe verte, ont fêté cette décision historique.
De leur côté, les opposants ont brandi des drapeaux bleus et prié à genoux.

« Après le droit de vote, il s’agit de la décision historique la plus importante pour la vie, l’autonomie et le plein et égal épanouissement des femmes », s’est félicité sur Twitter la maire de la capitale, Claudia Lopez.
La Colombie, à majorité catholique et où les églises chrétiennes protestantes exercent une grande influence, devient ainsi le cinquième pays d’Amérique latine à assouplir les conditions d’accès à l’avortement.
Cette pratique est déjà autorisée en Argentine, en Uruguay, à Cuba et au Guyana. Au Mexique, il est légal jusqu’à douze semaines dans les États de Oaxaca (sud), Veracruz (est), Hidalgo (centre) et Mexico.
