Le tribunal de Paris a jugé irrecevables ce vendredi 25 mars les poursuites en diffamation du Maroc contre des ONG et médias français ayant révélé ou dénoncé le recours par Rabat au logiciel d’espionnage Pegasus.
La juridiction a rendu dix jugements déclarant l’irrecevabilité des citations directes contre « Le Monde », « Radio France », « France Media Monde », « Mediapart », « L’Humanité », Forbidden Stories et Amnesty International.
Les décisions s’appuient sur un article de la loi de 1881 sur la liberté de la presse, qui « ne permet pas à un État, qui ne peut pas être assimilé à un particulier au sens de ce texte, d’engager une poursuite en diffamation ». Les conseils du Maroc ont indiqué qu’ils faisaient appel.
« Allégations mensongères et infondées » selon le Maroc
Comme d’autres pays, le Maroc a été accusé à l’été 2021 d’avoir utilisé le logiciel espion Pegasus, d’après une vaste enquête menée par un consortium de 17 médias internationaux sur la base de données obtenues par l’organisation Forbidden Stories et par Amnesty International.
Parlant d’« allégations mensongères et infondées », le Maroc avait enclenché plusieurs procédures judiciaires en France, en Espagne et en Allemagne.
Une fois installé dans un téléphone mobile, le logiciel permet d’accéder aux messageries, données et d’activer l’appareil à distance à des fins de captation de son ou d’image.
« Ce n’était pas inattendu, la jurisprudence était très largement dans ce sens », a réagi Me Simon Foreman pour Amnesty International, se félicitant que « le tribunal rappelle fermement le principe de la liberté de critique de l’Etat, sans avoir à craindre des poursuites ».
L’avocat du Monde, Me Christophe Bigot, a salué « des décisions conformes aux pratiques habituelles s’agissant d’actions engagées par un Etat et qui permettent de préserver la liberté de critique à l’encontre d’un pays ».
« Le Maroc, en interjetant immédiatement appel du jugement, renouvelle sa confiance en la justice française et s’en remet à la cour d’appel de Paris qui dira qu’Amnesty et Forbidden Stories ont joué les apprentis sorciers en publiant de fausses informations et en diffusant une fable invérifiée », ont déclaré les avocats du royaume, Me Olivier Baratelli et Me Rodolphe Bosselut.
Le Maroc a bien agi « en son nom »
Lors de l’audience du 26 janvier, le parquet avait requis l’irrecevabilité des poursuites, citant une jurisprudence « constante » dans ce domaine.
Les avocats du Maroc ne prétendaient pas que l’Etat en lui-même était recevable, mais qu’il pouvait agir au nom de ses services de sécurité et de renseignement.
Dans ses décisions, le tribunal a balayé ces arguments, estimant que le Maroc agissait bien « en son nom ».
Les demandes au titre de la procédure abusive, formulées par certains médias et ONG, ont en outre été rejetées.
Sur le fond des révélations Pegasus, une enquête a été ouverte le 20 juillet par le parquet de Paris.
