Les principaux médias danois vont s’unir pour négocier collectivement leurs droits d’auteur avec les géants du web comme Google et Facebook, a indiqué lundi l’un des responsables de l’initiative, une première en Europe.
Une trentaine de groupes, dont les télévisions publiques DR et TV2 et la quasi totalité du paysage médiatique danois, ont fondé une organisation qui verra officiellement le jour vendredi, a expliqué à l’AFP Stig Ørskov, directeur-général de JP-Politikens Hus, le principal groupe danois de presse écrite.
Elle les représentera de façon commune pour négocier et percevoir collectivement le montant des droits, dont les nouveaux droits dits « voisins » reconnus par une directive européenne.
« Cela fonctionnera comme une société de droits d’auteur dans nos discussions avec les grandes entreprises technologiques comme Google et Facebook », a précisé M. Ørskov, confirmant une information du Financial Times.
« Notre demande principale est que les géants de la tech paient une part juste pour les contenus d’information créés par les médias danois qu’ils utilisent et dont ils tirent profit », a-t-il plaidé.
L’objectif est de donner « une plus grande force de négociation » à l’heure où des groupes de presse déplorent « des accords séparés non transparents » entre les Gafa et certains médias, a insisté M. Ørskov. Les géants du web « utilisent une stratégie de division et de conquête et ce que nous espérons obtenir, c’est un accord collectif qui sera bénéfique pour l’ensemble du secteur », a-t-il dit.
Au sein de l’Union européenne, une directive de 2019 sur les droits d’auteur a instauré un « droit voisin » au bénéfice des éditeurs et agences de presse, afin de rémunérer l’utilisation de leurs contenus en ligne. Cette directive s’est déjà traduite par un accord cadre de Google avec la presse française en 2020, mais les paiements restent bilatéraux et l’accord ne couvre pas tous les médias.
Dans le modèle danois, chaque groupe renonce à défendre ses produits propres.
« Les entreprises de médias ont transféré leur mandat à l’organisation. Il s’agit d’une approche bien connue et éprouvée au Danemark et nous espérons obtenir les meilleurs résultats de cette manière, sans être nécessairement liés à un produit d’information spécifique », a souligné M. Ørskov.
L’approche, qui se veut une première en Europe, intervient alors que Bruxelles est en pleine offensive avec deux projets de directives (dites DSA et DSM) qui visent à renforcer considérablement la régulation des plateformes. Selon Stig Ørskov, les discussions avec les « Gafa » pourraient commencer « assez rapidement ». « Il y a déjà eu des contacts informels avec Google. Nous ne sommes cependant pas pressés et voulons faire les choses correctement », a-t-il conclu.
