En attendant la proclamation officielle des résultats de l’élection présidentielle du 4 décembre dernier et qui a vu le président Adama Barrow rempiler pour un second mandat d’après la Commission Électorale Indépendante, la Cour Suprême va se pencher sur la requête introduite par les avocats de Barrow pour annuler le recours introduit par Usainou Darboe et contestant les résultats. La Cour évoquera dans son rôle de ce 21 décembre cette affaire.
L’UDP a déposé une requête auprès de la Cour suprême contre le président élu Adama Barrow du Parti national du peuple (NPP), la Commission électorale indépendante (CEI) pour que le tribunal annule les résultats de l’élection présidentielle du 4 décembre alléguant d’irrégularités dans le déroulement du scrutin.
Pour l’ancien vice-président de la Gambie qui a accusé le président Adama Barrow et son Parti national du peuple (NPP) d’avoir soudoyé et induit l’électorat pendant la campagne électorale présidentielle et durant le scrutin, a également accusé la CEI d’avoir comploté avec le président Barrow pour utiliser des partisans du NPP comme présidents de Commissions de vote.
Lors de la première audience de la requête devant la Cour suprême, les avocats du président Adama Barrow ont déclaré avoir déposé un « avis de requête » pour que le tribunal rejette l’affaire sur la base de motifs constitutionnels. Les avocats ont fait valoir dans leur « avis de motion » qu’un président en exercice ne peut pas être jugé devant un tribunal en vertu de la Constitution de 1997 de la République de Gambie.
Pour les avocats du président Adama Barrow, il convient de rejeter la requête déposée contre leur client car, étant en violation des dispositions de la Constitution qui stipulent que « M. Barrow bénéficie de l’immunité constitutionnelle de poursuite qui lui est accordée en tant que Président de la République de Gambie en vertu de l’article 69 de la la Constitution, de telle sorte qu’aucune procédure civile ou pénale ne peut être engagée ou une quelconque poursuite contre lui pendant qu’il occupe ou exerce les fonctions de président à l’égard de tout ce qu’il a fait ou omis de faire, que ce soit dans un cadre officiel ou privé ».
