Le président tunisien Kaïs Saïed, qui s’est arrogé depuis juillet les pleins pouvoirs, a décidé de dissoudre le Conseil supérieur de la magistrature, organisme indépendant chargé de nommer les juges, l’accusant d’être partial et au service de certains intérêts.
« Le CSM (Conseil supérieur de la magistrature) appartient au passé à partir de ce moment », a déclaré dimanche 6 février le président de la Tunisie, Kaïs Saïed, dans une vidéo diffusée dans la nuit où on le voit discuter avec des ministres.
Il y accuse aussi cet organe constitutionnel indépendant de corruption et d’avoir ralenti des procédures, dont les enquêtes sur les assassinats de militants de gauche survenus en 2013.
Selon les observateurs, il vise ainsi le parti Ennahda, qui a contrôlé le Parlement et les différents gouvernements depuis la révolution de 2011 et la chute du dictateur Zine el-Abidine Ben Ali.
Interrogé au téléphone par Reuters à la suite de cette annonce, le président du Conseil supérieur de la magistrature a dénoncé une décision illégale visant à placer l’appareil judiciaire sous le contrôle du chef de l’État. Youssef Bouzakher a prévenu que « les juges ne resteront pas silencieux ».
Kaïs Saïed concentre tous les pouvoirs depuis le 25 juillet, quand il a limogé son Premier ministre et gelé le Parlement, une décision qualifiée de coup d’État par Ennahda et d’autres opposants. Il a depuis nommé un gouvernement mais prend ses décisions par décrets. Mi-décembre, il a annoncé un référendum cet été pour réformer la Constitution et des élections législatives en décembre.
Un décret en préparation
Le « mouvement du 25-Juillet », qui regroupe ses partisans, avait appelé samedi Kaïs Saïed à dissoudre le CSM pour « purger » le pouvoir judiciaire de « magistrats corrompus ». Le président a assuré « travailler sur un décret provisoire » pour réorganiser le CSM. Il y a quelques semaines, il avait déjà retiré un certain nombre d’avantages aux membres de l’institution.
« Malheureusement, dans ce pays, certains juges dans les tribunaux ont manipulé le dossier Chokri Belaïd », a dénoncé Kaïs Saïed, évoquant un dirigeant de gauche tué de trois balles devant son domicile le 6 février 2013.
Une importante manifestation est prévue dimanche à Tunis pour commémorer l’assassinat de ce militant et celui de Mohamed Brahmi, tué dans des circonstances similaires le 25 juillet 2013.
« Ce n’est pas le premier procès où ils essaient de cacher la vérité depuis des années », a ajouté Kaïs Saïed.
« Dans ce conseil, les postes et les nominations se vendent et se font selon les appartenances », a affirmé le chef de l’État, ajoutant : « Vous ne pouvez pas imaginer l’argent que certains juges ont pu recevoir, des milliards et des milliards. »
Pour lui, « la place des juges (du CSM) n’est pas là où ils se trouvent mais sur le banc des accusés ».
