Les sept médecins qui étaient jusque-là mis en examen pour homicide involontaire sont désormais poursuivis pour homicide volontaire. Ils encourent entre 8 et 25 ans de prison. Avec ce changement de qualification, le parquet considère que la mort de Maradona n’est pas le résultat d’une faute professionnelle ou d’une négligence de l’équipe médicale, mais que médecins et soignants n’ont rien fait pour empêcher sa mort quand celle-ci s’est matérialisée.
« Après tant d’injustices, la boucle est bouclée. Le plus important est le changement de l’accusation en homicide avec préméditation », a déclaré à l’Agence France-Presse un membre du parquet de San Isidro (banlieue de Buenos Aires), en charge de l’enquête.
Cette aggravation des charges est liée à la parution début mai d’un rapport d’experts, qui a conclu que Maradona avait été « abandonné à son sort » par son équipe soignante, dont le traitement « inadéquat, déficient et imprudent » a conduit à une lente agonie. « Les signes de danger de mort qu’il présentait ont été ignorés », estimaient encore les vingt experts, dont les médecins légistes qui ont pratiqué l’autopsie et des spécialistes de diverses disciplines médicales, et les soins infirmiers prodigués sont « entachés de déficiences et d’irrégularités ».
Maradona, qui souffrait de problèmes aux reins, au foie et au cœur, est mort d’une crise cardiaque le 25 novembre 2020, quelques semaines seulement après avoir subi une opération du cerveau pour un caillot de sang.
Sept personnes ont été mises en examen par le procureur de la République de San Isidro : le neurochirurgien Leopoldo Luque, principal accusé, la psychiatre Agustina Cosachov, un psychologue, deux infirmiers (un homme et une femme) qui étaient au chevet de Diego Maradona, ainsi que le superviseur de ces infirmiers et un médecin coordinateur de l’hospitalisation à domicile.
