La Cour spéciale militaire a rejeté jeudi 24 juin toutes les exceptions soulevées par les avocats de Kelly Ondo Obiang et ses co-accusés les putschistes du 7 janvier 2019 et s’est déclarée compétente à juger les prévenus.
Le lieutenant Kelly Ondo Obiang et ses 8 co-accusés étaient à la barre pour jeudi 24 juin 2021, c’était pour la 3ème fois après les audiences du 18 et du 21 juin dernier. Il sied de noter que, les avocats des putschistes ont soulevé plusieurs exceptions. Ils contestent la compétence de la Cour. Selon le code pénal, lorsqu’une procédure militaire implique au moins un civil, la cour spéciale militaire n’est plus compétente. L’affaire est renvoyée vers la Cour criminelle. Les avocats de la défense demandaient que toute la procédure soit transmise à la Cour constitutionnelle pour compétence. Ils sollicitent par ailleurs la comparution forcée de Frédéric Bongo, frère du président Ali Bongo Ondimba et chef des renseignements à la présidence de la République gabonaise à l’époque des faits. Ils exigent également la comparution d’Etienne Massard Makaga Kabinda, ministre de la Défense au moment du coup d’État manqué. Pour rappel, la Cour a rejeté toutes les exceptions et s’est déclarée compétente pour juger le lieutenant Kelly Ondo Obiang et ses co-accusés. La prochaine audience est prévue pour lundi 28 juin dès 9 heures.
